Property Accesses and Driveways
The road reserve located outside of your property boundary, which includes the footpath and nature strip, is public land owned by the State. To ensure a reasonable level of safety for all road users, including motorists and pedestrians, Council regulates work within the road reserve. You must obtain written approval from Council for any works you wish to undertake within the road reserve. This is a requirement of Subordinate Local Law 1.15 (Carrying out works on a road or interfering with a road or its operation) 2011.
The construction of a property access or driveway to any lot, private or commercial, is the property owner’s responsibility to construct and maintain in accordance with Council's Use of Roads Policy.
You will need to abide by the minimum standards as shown in Council's drawings, the relevant planning scheme and Councils Use of Roads Policy. If the access cannot be constructed in accordance with these standards, you may be required to engage a suitably qualified engineer to design an appropriate property access or driveway.
Lodging an Application to Undertake Works on a Road Reserve
The installation of a new, upgrade to or removal of an existing property access or driveway must be approved by Council by submitting an Application to Undertake Works on a Road Reserve. A person must not, without written approval from Council, conduct works on a road or interfere with the road and its operation.
It is important to ensure all information related to your application is submitted together. Prior to submitting your application, please ensure the following information is included. Failure to provide any of the below mandatory items will result in a delay to the processing of your application until the required information is provided.
- Completed Application to Undertake Works on a Road Form (Page 1)
- Signed ‘Standard Conditions of Permit’ (Page 2)
- Copy of Public Liability Insurance (Minimum of $20 million)
- Copy of any relevant plans or description/sketch of property access (e.g. driveway is located approx. 20m from the southern boundary of my property)
- Pay the relevant fee. Fees can be found in Council's Register of Fees & Charges
Council requires a minimum of ten (10) business days to process the application from the date the payment has been receipted. It is important to note that applications will not be accepted within ten (10) days of the scheduled start date.
If a driveway is proposed to access a state-controlled road, approval is required from the Department of Transport and Main Roads. You can search road ownership information here: Road Lookup - QLDTraffic.

Construction Information
The construction, maintenance standards and requirements must be conducted in accordance with Council's Use of Roads Policy and the conditions within the issued works on a road permit.
Standard Drawings show the minimum standard that Council has adopted with regard to certain types of work. Standards have been developed for works on roads, drainage, water, and other miscellaneous activities. In addition to Council’s Standard Drawings, Council has also adopted the IPWEAQ Standard Drawings, which were developed by industry for local government in Queensland. Each drawing reflects the latest and best practices with up-to-date specifications for current land developments. The applicable Standard Drawing(s) will be determined as part of the application process. In certain situations, a more detailed design may be required for the property access or driveway. In this instance, an RPEQ Engineer will be required to design aspects of the property access or driveway.
